1. Introduction

3MPSTUDIO ("we," "us," or "our") operates Ezy Gym, a cloud-based gym and fitness management platform available at https://ezygymapp.com and https://go.ezygymapp.com.

We recognize the importance of protecting children's personal information and supporting parents and legal guardians in understanding how information about their children is collected, used, stored, and protected.

This Children's Privacy Policy explains our intended practices for student information processed through Ezy Gym's Homeschool Physical Education (PE) Partner Program.

This policy supplements our general Privacy Policy and Terms & Conditions.

Ezy Gym provides software for independent homeschool PE providers. We do not independently operate or supervise the physical education programs managed through the Platform.

2. Scope of This Policy

This policy applies to personal information about children under 18 processed through Ezy Gym's Homeschool PE student-management features, including information provided by authorized program administrators and parents or legal guardians.

Certain privacy laws, including the U.S. Children's Online Privacy Protection Act (COPPA), impose specific requirements for children under 13.

Ezy Gym intends to implement age-appropriate protections and applicable parental notice and consent requirements before activating student features involving real children's information.

Student profiles will be managed by authorized adults. Independent student login accounts are not planned for the initial Homeschool PE implementation.

3. Information We May Collect About Students

When the applicable student-management features become available, participating Homeschool PE providers may process the following information.

A. Student Information

Student first and last name.
Grade level.
Age group derived from grade level.
Program enrollment and membership status.
Assigned classes and schedules.
Class reservations and cancellations.
Attendance and check-in records.
Student-specific check-in identifiers.

B. Parent and Guardian Information

Parent or legal guardian name.
Email address.
Relationship to the student.
Account authentication information.
Authorization to manage student enrollment and bookings.
Guardian consent status and associated records.

C. Consent and Security Information

Where necessary to document authorization and protect student information, Ezy Gym may process:

Consent date and time.
Version of the privacy notice accepted.
Consent or authorization method.
Limited technical information used to document consent.
Guardian invitation and account-verification records.
Records of consent withdrawal or access revocation.
Security and access audit information.

We intend to collect only information reasonably necessary for authorized program management and applicable legal obligations.

4. Information We Do Not Intend to Collect

The initial Homeschool PE student-management implementation is not designed to request:

Student birth dates.
Student personal phone numbers.
Student email addresses for independent login.
Medical histories.
Allergy or medication records.
Student photographs.
Precise student location tracking.

Participating organizations should not enter unnecessary sensitive information into general-purpose fields.

If Ezy Gym later introduces features involving additional categories of student information, we will evaluate the applicable privacy requirements and update our notices and consent procedures before enabling those features.

5. How Student Information Is Used

Student information may be used to:

Create and maintain student profiles.
Manage enrollment in homeschool PE programs.
Assign students to appropriate classes or age groups.
Schedule, book, and cancel classes.
Record attendance and authorized check-ins.
Allow verified guardians to manage linked students.
Support authorized instructors and program administrators.
Protect student records from unauthorized access.
Respond to appropriate guardian requests.
Meet applicable legal and recordkeeping requirements.

We do not intend to use student information for behavioral advertising, targeted marketing, or the creation of advertising profiles.

We do not sell children's personal information.

6. Parent and Guardian Authorization

Before guardian-managed student features become available for real-world use, Ezy Gym intends to implement an authorization process designed to associate each student with an appropriate parent or legal guardian.

The planned process includes:

A student profile created by an authorized program administrator.
An invitation sent to the designated guardian.
Verification of the invited guardian's account.
Presentation of the applicable privacy notice.
Recording of required consent or authorization.
Activation of permitted student-management functionality only after the applicable requirements have been satisfied.

Guardian permissions may include viewing linked student records, requesting enrollment, managing bookings, and accessing student check-in identifiers.

The precise consent and verification methods will be established and validated before launch. An invitation email or ordinary account login alone should not be assumed to satisfy all legally required parental verification standards.

7. Guardian Access and Control

Authorized guardians will be able to access information associated with students properly linked to their accounts, subject to the permissions supported by the Platform.

Planned guardian controls include:

Viewing linked student profiles.
Reviewing class schedules and bookings.
Requesting or managing student enrollment.
Reviewing attendance information.
Accessing or regenerating authorized check-in identifiers.
Requesting correction or deletion of student information.
Withdrawing consent where applicable.

Access may be suspended or revoked when the guardian's authorization ends, consent is withdrawn, or a valid legal or security requirement applies.

We will not intentionally provide guardians with access to unrelated students or other organizations' private records.

8. Information Sharing

Student information may be made available to:

Authorized Homeschool PE Providers: Program directors and appropriately authorized staff who require access to administer classes, enrollment, and attendance.

Verified Parents and Guardians: Adults authorized to access and manage their linked students.

Technology Service Providers: Providers supporting hosting, authentication, email delivery, security, and related operations, subject to applicable contractual and legal protections.

Legal Authorities: Where disclosure is required by applicable law or valid legal process.

Safety and Security Purposes: Where disclosure is lawful and reasonably necessary to investigate unauthorized access, security incidents, or threats to safety.

We do not permit unrestricted public access to student profiles.

Student information will not be shared with advertisers for targeted advertising.

9. Data Security

Ezy Gym intends to apply safeguards appropriate to the sensitivity of children's personal information.

These safeguards include planned controls such as:

Role-based access permissions.
Organization-specific data isolation.
Verified guardian-to-student relationships.
Restricted database access.
Secure authentication.
Protected guardian invitations.
Controlled student check-in identifiers.
Access and consent audit records.
Revocation of access when authorization ends.

These protections are subject to implementation, security testing, and ongoing maintenance.

No electronic system can guarantee absolute security.

Participating organizations must also protect their own staff credentials, use appropriate permissions, and comply with applicable child-protection obligations.

10. Children's Data Retention and Deletion

3MPSTUDIO generally retains personal information for as long as the relevant account or participating organization remains active on Ezy Gym and the information is reasonably necessary for authorized program operations.

Following termination of an account or organization, we aim to delete or de-identify associated personal information within 30 days, except where longer retention is necessary for legal compliance, financial recordkeeping, security, dispute resolution, or other lawful purposes.

Certain information, including transaction records, consent records, and legally required audit information, may be retained for a longer period.

Information stored in backups may remain for a limited additional period according to applicable backup retention procedures.

Parents and legal guardians may request access, correction, or deletion of a child's information, subject to verification of their authority and applicable legal requirements.

A guardian's request to withdraw consent or delete a student's information will be handled according to applicable law and the operational requirements of the Platform. Withdrawal of consent may require the associated student services to stop.

Implementation note: The 30-day deletion target and student deletion procedures must be validated against actual application functionality and backup practices before this section is relied upon operationally.

11. Responsibilities of Participating Homeschool PE Providers

Homeschool PE providers using Ezy Gym are responsible for their own program operations and applicable legal obligations.

Depending on the circumstances, these responsibilities may include:

Providing appropriate notices to families.
Confirming the authority of parents or legal guardians.
Obtaining required permissions and consents.
Keeping student information accurate and limited to necessary purposes.
Restricting staff access to authorized personnel.
Responding to guardian requests in coordination with Ezy Gym.
Complying with applicable privacy, educational, and child-protection laws.

3MPSTUDIO provides software tools and supporting data-processing services. This does not automatically transfer all of a provider's legal responsibilities to Ezy Gym.

12. Children and Direct Use of the Platform

The initial Homeschool PE student-management features are intended to be operated by authorized adults.

Students will not be required to create independent accounts or provide personal login credentials.

Ezy Gym does not intend to offer student-directed social networking, messaging, advertising, or public student profiles as part of these initial features.

If a child attempts to create an account through a process intended for adult business owners, the account may be restricted or removed as appropriate.

13. International Privacy Considerations

Ezy Gym may support participating organizations in multiple countries.

Different jurisdictions may impose additional requirements concerning children's information, parental authorization, data processing, retention, and international transfers.

We will assess and apply relevant requirements before enabling student-data processing in jurisdictions where additional safeguards are necessary.

Texas governing-law provisions in our general Terms do not eliminate mandatory privacy protections available under applicable law.

14. Changes to This Policy

We may update this Children's Privacy Policy as our Services develop or legal requirements change.

Where required, we will notify affected organizations or guardians of material changes and obtain additional consent before implementing processing that legally requires it.
